Is the AFK penalty only in the battlegrounds?

Can you reported for being AFK anytime/anywhere on a PVP server?

Nope! Although if you do have to AFK on a PvP server make sure you do it in an unflagged zone, in a town or city with gaurds to protect you, or somewhere safe where you're not likely to be noticed by the opposing faction. Because if they see you AFK they will "report" you.

And by "report" you, I mean kill. ;)
