who would actually use this?

I saw this for sale at a poison dealer in Old Town Stormwind.  Not the one in SI7 but the one in the center of the area accessible through an alley.  I bought it just to try it out and used it in WSG at level 29.  I ended up switching back midway through the battle because it is a pointless item.  It does not cause enough damage when it procs to come anywhere near an offhand weapon, especially when coated with poison.  If it had a cool animation like your character spitting out a huge cloud of poison, it might be worth having as a conversation piece or for shock value but it really doesn't do anything.  It's useless.

I use it more for Role-playing purposes. It kind of looks like the Death Note from the anime Death Note, so I dress up as Light and run around Stormwind and spam a macro that says "Writes down name in notebook"

Otherwise i;ve found no real practical use for it.

Anyone knows if it scales with anything?

At lvl 20 feral druid (We can't dual wield anyways) this is awesome! Getting hit by something and spitting poison at it, lessing what we need to do by 100. It kicks ass! So worth the 40s.
On my lvl 34 Hunter, I was weilding this and Toxic Revenger with Beastslayer enchant and went into WSG. Im 34 in the 30s, so I thought I'd be eaten alive. No! I kicked ass! I did the most damage, and captured the flag twice! I killed a priest and a rogue, lvls 39 and 37 respectively, with this. Spat through the priests shield and killed it, and outpoisoned the rogue. I was unstoppable.
This is one of the coolest things in Wow (for us low lvls) and would rip ass if it got stronger as the character lvl increased.
